I. Functions and duties
Advise the leaders of :
- Look at the guidelines, policies and laws related to the functions of the Department proposes to implement . Draft , suggestions of legal documents relating traders policy , market policy , commodity policy , such as freight traffic management , business management and commodities trading services in the province , including goods and services banned from business , limited business and business conditions , according to market development objectives , development strategy oriented socio- economic provincial and commercial civilization . Periodically review, findings and recommendations of the competent authorities for promulgation , amendment , supplement regulations concerning commercial sector .
- Propose and coordinate construction, organizational guidelines and implementation plans , plans , mechanisms and policies to develop infrastructure network wholesale trade , retail sales , including : the type of of market , commercial centers , supermarkets system , the system stores , cooperative trade , service trade , commercial agents systems , franchise and other types of infrastructures commercial floor ; Permanent Council project appraisal petroleum storage investment , investment plans and other matters prescribed by law .
- Lead and coordinate with concerned agencies in guiding and implementing mechanisms and policies to encourage the expansion of business networks , develop organizational links of goods circulation , forming channels steady flow of goods from producers to consumers in the province .
- Implement mechanisms and incentives to encourage and support the production , business and life for ethnic mountainous and remote province ( such as supply of essential goods , support circulation of goods and commercial services ... )
- Coordinate with Planning Department : synthesis and processing of market information on the province of the total flow of goods , aggregate supply , aggregate demand , and the reserve price fluctuations of the surface essential goods , commodities policies for ethnic minorities in mountainous, remote and isolated . Proposal to Department leadership on measures to regulate the circulation of goods in each period .
- To implement policies , plans , programs and projects to boost development and export of goods , development of services exports and imports of goods in the province
- Manage the activities of import and export goods and domestic business enterprises invested abroad , foreign traders have no representative in Vietnam in the province .
- Guiding and helping traders learn , market development .
- Implementing state management for electronic commerce activities . Coordinate with other agencies and units related infrastructure building e-commerce applications in the province .
- Coordinate implementation of organizational policies , plans and programs to foster and develop human resources for management of electronic commerce in the area .
- Coordinate program implementation , planning , trade promotion schemes to boost exports , supporting businesses in the province to build and develop the brand in Vietnam.
- Implementing state management for trade promotion activities in the province , implementation and monitoring and supervision of the registration of organizing fairs , trade shows , promotions for merchants .
- Advise the Director of the implementation of organizational development , market management in the province towards a healthy , civilized .
- Coordinate with the industry , the local guide and inspect the implementation of the legislation in the field of trade organizations , business and individuals in the province as prescribed by law .
- Coordinate with the market management department to monitor the situation and advise solutions combating smuggling and trafficking in smuggled goods , prohibited goods , against production and trafficking in counterfeit goods and shoddy goods in breach of regulations on intellectual property ; against acts of speculation and market manipulation , fraudulent trade organizations , business and individuals in the province .
- Manual and implementing the provisions of the competition law , anti-monopoly , anti-dumping , anti-subsidy , to protect the interests of consumers and ensure fair competition environment in the area province . The proposal with the relevant amended regulations , the text has not promulgated in accordance with competition law .
- Proposal to the Department of the requesting organizations and individuals involved in the province , providing information and documents necessary for the implementation of the tasks assigned to the provisions of competition law , anti- monopoly , anti-dumping and anti-subsidy and protection of consumer interests .
- Collect , database construction , management , providing enterprise communication about the dominant position on the market , the monopolist has its headquarters in the province , the competition rules association , of the exemptions .
- Permanent and perform reconciliation in the protection of consumers' interests ; involved in the investigation of disputes , breach of commercial activities in accordance with law and as authorized .
- To assist the Department of tasks performed Permanent National Committee for Economic Cooperation implementing plans , programs and specific measures of economic integration , international trade in the province after being approved browser
- Helping to advise the Department of Provincial People 's Committee to manage state enterprises , collective economic organizations , the private sector as prescribed by law .
- Guide and assist and supervise activities of associations and non-governmental organizations in the fields of trade , trade in services as prescribed by local law .
- Guide professional in the fields of trade for the Department of Trade and Industry , Department of Economics in the province of DPC . Help the Chamber of Industry and Commerce / Economics professional guidance for responsible public servants not track industrial , commercial commune .
- To implement the research plan , application of advanced science and technology in commerce under the jurisdiction of the department; building information storage system , providing commercial documents under the provisions of the law .
- Đề xuất và thực hiện chương trình cải cách hành chính của Sở theo mục tiêu và nội dung chương trình cải cách hành chính của Uỷ ban nhân dân tỉnh.
- Tổ chức thực hiện các dịch vụ công trong lĩnh vực thương mại thuộc phạm vi quản lý của Sở theo quy định của pháp luật. Cụ thể là: xem xét, đề xuất việc giải quyết cấp, gia hạn, thu hồi các loại giấy phép, giấy chứng nhận cho thương nhân nước ngoài đặt văn phòng đại diện; thương nhân kinh doanh các ngành, nghề, mặt hàng hạn chế kinh doanh, kinh doanh điều kiện, như: mua, bán thuốc lá, rượu, xăng, dầu, gas; nhượng quyền thương mại; giám định thương mại; bán hàng đa cấp; kinh doanh trung tâm thương mại, siêu thị; tổ chức hội chợ triển lãm …
- Thực hiện công tác thông tin, báo cáo định kỳ và đột xuất về tình hình thực hiện các chương trình, kế hoạch, đề án phát triển lĩnh vực thương mại tại địa phương theo quy định của Uỷ ban nhân dân tỉnh và Bộ Công Thương; Được yêu cầu các tổ chức, cá nhân trên địa bàn tỉnh cung cấp các thông tin và các nội dung có liên quan đến chức năng, nhiệm vụ của phòng.
- Thực hiện nhiệm vụ các Ban Chỉ đạo và các nhiệm vụ khác do Lãnh đạo Sở giao.
