I. FUNCTIONS, TASKS AND POWER
o As a specialized agency of Dong Nai Province People’s Committee, the Department of Internal Affairs assists the provincial People’s Committee with internal affairs, including the following fields: organizing and staffing administrative agencies; organizing local authorities, administrative-territorial units, staff and civil servants in communes, wards and towns; organizing associations, non-governmental organizations and public services within its sphere of management.
o It is placed under the direct management of the provincial People’s Committee and simultaneously under the professional management of the Ministry of Internal Affairs.
o It enjoys the legal personality, has its own seal and its own account at Dong Nai treasury.
o It performs its tasks and power in accordance with the laws and regulations described in “regulations on organization and activities of the Department of Internal Affairs” which was enforced along with Decision No. 2437/2004/QD-UBT dated June 21 2004 of Dong Nai People’s Committee.”
II. MACHINERY ORGANIZATION:
o It has a director and two to three deputy directors.
o Its director and deputy directors are appointed and dismissed by the chairman of the provincial People’s Committee according to standards and titles which are promulgated by the Ministry Of Internal Affairs in accordance with regulations of the Party and the Sate on state official appointment
o The system of the Internal Affairs Department includes:
1- Office
2- Division of Inspectors
3- Division of Organization – Human Resources
4- Division of Building up Authority
5- Division of Civil Servants
o The number of civil servants of the Internal Affairs Department is decided to be regular by the Provincial People’s Committee in the total number of civil servants that are annually allowed to be regular officials of the province.
III. WORKING REGULATIONS
o It works in accordance with leader regime.
o The department director bears the highest responsibility to the chairman of the Provincial People’s Committee for finishing the department’s tasks and simultaneously is responsible to the Ministry Of Internal Affairs for professional affairs which are managed by this ministry
o The Department deputy directors assist the director in monitoring, giving directions and managing affairs that are assigned by the director and other unexpected affairs.
o The Chief of the office, the chief inspector are responsible to the director for organizing, giving directions and managing civil servants to carry out duties assigned in conformity with regulations.

As a consultative unit, it assists the director with the following affairs:
o Submit decisions on delegating power over mechanism organization to the People's Committee at district levels and other specialized agencies in the province to the Provincial People's Committee.
o Submit projects on establishment, merger and dissolution of specialized agencies at provincial and district levels to the Provincial People's Committee in conformity with regulations of the government and the Prime Minister so that the Committee submits the projects to the Provincial People’s Council for decision within the Council’s competence.
o Assess regulations on functions, tasks, power and organization of mechanism of specialized and non-productive agencies and civil services that are under management of the Provincial People's Committee and then submit these regulations to the Committee.
o Coordinate other specialized agencies at the same levels to instruct the people’s committees at district levels how to stipulate functions, tasks, power and organization of specialized bureaus, non-productive units that are under management of the people’s committee at district levels
o Assess or take part in assessing projects on establishing, dissolving, privatizing and innovating state-owned enterprises; take part in assessing regulations of state-owned enterprises and other enterprises whose part of financial contribution is made by the state.
o Act as a chairman, presiding and coordinating relevant specialized agencies of the province to instruct and examine the self-employment and self – responsibility taking of non-productive units in conformity with law; coordinate concerned agencies of the province to classify and rank administrative agencies and non-productive units of the province.
o Submit programs, methods to organize and carry out tasks of state administrative reform in the province to the Provincial People's Committee; monitor, instruct, examine the implementation of government’s program on state administrative reform in the province.
o Assess decisions on permission for establishment, dissolution and approval for regulations of associations and non-governmental organizations in the province in conformity with law, and then submit them to the chairman of the Provincial People's Committee for approval within his competence.
o Assess decisions on permission for state-owned enterprises to rename or permission for non-productive associations and units that are directly under state-owned enterprises to use their own seals in conformity with state regulations and then submit them to the Provincial People's Committee for approval.
o Assess decisions on permission for establishment of steering committee, consultancy board and other multi-discipline organizations in accordance with regulations of central agencies and demands of the province and then submit them to the Provincial People's Committee for approval.
o Elaborate plans for personnel of the province and then submit them to the Provincial People's Committee and the committee submit it to the Provincial People’s Council so that the council decides the total number of regular civil servants of non-productive agencies before reporting the Ministry of Internal Affairs.
o Submit projects, which allow the number of regular civil servants in specialized agencies, that are under management of the Provincial People's Committee or people’s committee at district levels, to the chairman of the Provincial People's Committee; and then carry out these projects after they are approved.
o Instruct and manage personnel of people’s committees at district level, specialized agencies that are directly under the Provincial People's Committee and non-productive units. These committees, agencies and units ensure the total daily cost by themselves.
o Giving statistics on administrative agencies, non-productive units, associations and non-governmental organizations in accordance with instruction of the Ministry of Internal Affairs
o Do other duties assigned by the Director.

As a consultative unit, it assists the director with the following affairs:
o Help the Provincial People's Committee to study, instruct and monitor organization and activities of authority systems at all levels in the province; coordinate concerned agencies to organize and instruct elections to choose members of the National Assembly and members of the people’s councils at all levels in conformity with law and instructions from central state; settle complaints and accusations of citizens on the implementation of law regulations, that are about election, synthesis of election results to choose delegates of People’s Council and members of People’s Committee, and comply with all necessary formalities so that the Provincial People's Committee submit them to the Prime Minister or Its chairman for approval on election titles in conformity with law
o Help the Provincial People's Committee to manage training affairs, improve knowledge of law, state management, administrative management for delegates of the People’s Council and member of People’s Committee at district and commune level; Collect and classify statistics on the quantities and quality of delegates of the People’s Council, members of People’s Committee at all levels, officials and civil servants at district levels for reports in conformity with regulations
o Study the organization and activities of the government mechanism at all levels in order to find out illogicalities and suggest that the Provincial People's Committee petition the government for modifications appropriate to reality in order to improve effectiveness.
o Study and petitions for policy and guidelines to build up and strengthen local authorities and policies that are suitable to local officials and then submit them to the Provincial People's Committee for approval
o Monitor and manage documents on elections to choose delegates of the National Assembly, delegates of the People’s Council at all levels for terms of office.
o As for administrative border affairs:
- Submit projects for establishment, merger together, separation among and adjustment to the provincial administrative units to the Provincial People's Committee so that the Committee submit the projects to the authority, that has the competence the projects fall within, for consideration and decision.
- Organize the implementation of rules on managing, drawing and adjusting provincial administrative borders in accordance with instruction of the Ministry of Internal Affairs.
- Monitor and manage provincial administrative borders (including map sets, documents on administrative borders and landmarks); prepare for proceedings to ask for establish, merge, separate and adjust the borders; upgrade administrative units in conformity with regulations, instructions and relevant state regulations.
- Help the Provincial People's Committee to solve disputes over administrative borders under provincial level.
- Collect and classify the disputes which receive different solutions and then submit them to the Provincial People's Committee so that the Committee submits to the authority, that has the competence the projects fall within, for consideration and decision.
- Collect, classify and manage provincial documents on administrative borders, landmarks in conformity with the Ministry of Internal Affairs and relevant ministries.
- Collect and accumulate materials on administrative borders to make contribution towards building provincial monograph for archive and research; make summary reports on administrative border affairs in the province according to requirements of the province and the Central.
o Monitor and suggest implementing democratic status at grass-roots level.
