I. INFORMATION ABOUT FUNCTION, TASK, POWER AND ORGANIZATION
1. Function
-
The Department of Industry of Dong Nai province (hereinafter called Dongnai Department of Industry) is a specialized agency of the People's Committee of Dong Nai province. It assists the provincial People's Committee in enforcing the state management on industry and craft industry consisting of: mechanics, metallurgy, chemicals (including pharmaceutical chemistry), electricity, industrial explosives, consumer industry, food industry and other processing industries. It manages public services within the field of industry in the province in accordance with the provisions of the law.

The Dongnai Department of Industry is fully and directly controlled by the provincial People's Committee and simultaneously directed, instructed and inspected for professional knowledge by the Ministry of Industry.
2. Duty and Power
-
To submit proposals to the provincial People's Committee for promulgating decisions, instructions on the management on the activities of industry and craft industry in the province in accordance with the provisions of the law.

To submit the agreement with the Ministry of Industry to the provincial People's Committee to approve industrial development plan which is in line with industrial development plan of the whole country and region; in line with social - economic development of the province.

To assist the provincial People's Committee in organizing, directing, guiding and checking the implementation of legal documents, master plans and plans for industrial development which have been approved; To propagandize, popularize, educate the law and information about activities of industry and craft industry in the province.

To propose mechanisms and preferential policies in line with the local conditions as to attract domestic and foreign investment in developing the industry in the province.

As for the management on mechanics, metallurgy and chemicals
-
To organize, direct the development of mechanic products, automatic mechanics - electronics, key industrial electronics in the province;

To instruct the implementation of mechanisms and policies of the Government, Ministry of Industry and provincial People’s Committee on developing mechanics, metallurgy, chemicals and key products of mechanics, mechanics - electronics in the province.

As for management on electricity
-
To submit proposals to the provincial People's Committee for promulgating regulations on the management of rural electricity; To enforce and implement regulations on protecting safety corridor of high voltage electricity grid and other electricity projects in the province;

To draw up plans for developing electricity in the province and submit them to the provincial People's Committee as to get the approval from the Ministry of Industry; To supervise the implementation of these plans after they have been approved;

To submit to the provincial People's Committee investment projects to construct low voltage electric network in rural areas within its scope of operation; To cooperate with relevant department to work out measures to calculate the price of electricity in the province in accordance with Government's price frame;

To coordinate with relevant agencies in drawing up plans for training officials, technical workers for organizations which manage electric networks in rural areas.

To assist provincial People's Committee in granting, adjusting, withdrawing and prolonging electricity operation licenses.

As for management on industrial explosive material:

To enforce legal regulations on supplying, maintaining, transporting and using industrial explosives in the province;

To co-ordinate with relevant agencies to carry out the inspection, check and to deal with violations on the management, maintenance, transport and use of industrial explosives in the province in accordance with the provisions of the law.

To assist provincial People's Committee in granting, adjusting, withdrawing and prolonging industrial-explosive-using licenses.

As for management on consumer industries, foodstuff industries and other processing-industries:

To instruct the implementation of master plans, plans for the development of consumer industries, foodstuff industries and other processing-industries in the province; To co-ordinate with other relevant departments to draw up general and detail plans for processing factories, raw material regions of every branch in accordance with the plan for the social- economic development of the province and submit them to the provincial People's Committee for approval;

To submit to the provincial People's Committee programs, projects on the development of consumer industries, foodstuff industries and other processing industries in line with plans for the development of processing units, raw material regions.

As for management on industry promotion
-
To submit to the provincial People's Committee programs, plans of industry encouragement in industrial branches in the province for approval; To guide and organize the implementation of these projects, plans or programs after having approval of the provincial People's Committee.

Basing on the social - economic development and requirements of industrial encouragement in every period, to propose the list of industries, craft industries of several of economic sectors will receive the support fund from the Industry Promotion Fund of the province.

To submit plan for using or allocating provincial industry encouragement fund to the provincial People's Committee for approval; To considerate, issue and balance the industry encouragement fund in accordance with regulations of the provincial People's Committee.

As for Management of industrial zones, industrial complexes, industry - craft zones and collective economy

To assist the provincial People's Committee in organizing the development of industrial zones, industrial complexes, industry - craft zones having industries and professionals in line with the plan for developing industries and with social - economic development plans in the province;

To co-ordinate with relevant departments, agencies and People's Committee at various levels to propose regulations on implementing State's policies and mechanisms to grant preferential on investment, land, finance, science - technology and environmental protection related to construct infrastructure and transport system or to build new industrial zones, industrial complexes, industry - craft zones in the province;

To instruct organizations and individuals of various economic sectors to make investment plan for developing industrial production in the province.

To organize, instruct, train and transfuse careers, and develop traditional craft to enterprises in the province; To launch programs or projects to exchange experiences or to visit, survey, coordinate in economic cooperation or to create chances for enterprises, organizations and individuals to participate professional associations;

To instruct how to develop collective economy or to teach the methods for organizing and operating industry, craft-industry cooperatives; To classify cooperatives and to propose measures for solving the difficulties in developing collective economy; To build up and develop new cooperatives.

To take part in assessing or assess investment projects in the field of industry of the province in accordance with the provisions of the law; To coordinate with relevant agencies to instruct and check the production and business of enterprises in the province.

To suggest the provincial People's Committee to grant, adjust, withdraw or prolong the duration of other licenses in accordance with its competence.

To direct and check the implementation of regulations on technical safety for equipments, substances subject to obey the labor safety requirements in industrial branches in the province in accordance with state regulations.

To carry out international cooperation in the field of industries assigned by the provincial People's Committee.

To conduct researches, apply scientific and technological advancements into industrial activities; To instruct the implementation of state regulations on technical standards, rules of technique, quality of industrial products; To build up information systems as to store or supply industrial data in accordance with provisions of the law.

To direct and organize public services in the field of industries in accordance with regulations of the law; to manage and direct the operation of organizations controlled by the Department.

To assist the provincial People's Committee in implementing state management on industrial enterprises in the province in accordance with provisions of the law.

To assist the provincial People's Committee in directing the People's Committee of districts, towns, cities under the provincial management to implement state management on industry, craft industry in the province.

To sum up, evaluate the situation of industries in the province (including activities of industrial zones, export processing zones, high tech industrial zones and non-state industry) in accordance with regulations of Industry Ministry. To periodically report or make unscheduled reports on the fulfillment of tasks assigned by the provincial People’s Committee and Industry Ministry.

To assist the provincial People's Committee executing the state management on the activities of non - governmental association and organizations operating in the field of industries and craft industries in the province in accordance with provisions of the law.

To inspect, check and handle violations in industrial activities in the province in accordance with provisions of the law.

To manage the organization, personnel, implement salary benefits, incentive policies, the commendation and discipline to officials and employees of the Service; train and build up staffs within the Service jurisdiction; guide on the implementation of regulations on title, standard, technical rank, specialty in industrial branches within the Service jurisdiction.

To manage finance, assets of the Department in accordance with provisions of the law and within its competence devolved by the provincial People's Committee.

To fulfill other duties assigned by the provincial People's Committee.
