General functions and tasks:
The Department of Resources and Environment is a specialized agency of Dong Nai Province People’s Committee. It assists the provincial People’s Committee in the implementation of State management of land resources, water resources, mineral resources, environment, and hydrometeorology, geodesy and maps, exploitation of mineral resources into ordinary building materials, such as earth, sand, stones, lime…
The Department of Resources and Environment of Dong Nai Province is placed under the direct and global management of the provincial People’s Committee and the concrete guidance of professional knowledge and skill of Resources and Environment Ministry.
Dong Nai Department of Resources and Environment is a legal person, has its own seal and accounts with the State Bank of the province.
The Dong Nai Resources and Environment Department has its office located at Dong Khoi Street, Tan Hiep ward, Bien Hoa City, and Dong Nai Province.

II. Responsibility and authority
1.
Submit to Dong Nai People’s Committee:
a) Draft of decision, instruction and any other
documents issued under the authority of provincial People’s Committee concerning
resources and environment sector;
b) Draft of decision on regulating function, duty,
authority and mechanism of its subdivisions in accordance with regulations and
laws.
c) Draft of 5-year and annual planning and proposal,
the program and project regarding resources and environment, and the solutions
to managing and protecting resources and environment in local areas.
2. Submit to Chairman of provincial People’s
Committee:
a) Draft of instruments under the issuing authority
of Chairman of People’s Committee with regard to resources and environment;
b) Draft of documents specifically regulating the
working relation between Department of Resources and Environment and other
relevant departments as well as People’s Committee of Long Khanh district and
township, Bien Hoa city (hereinafter generally called People’s Committee of
district level).
c) Draft of decision on founding, merging,
dissolving, and reorganizing professional divisions, subdivisions and
subordinate units in Department of Resources and Environment.
3. Give instructions to work out legal normative
literatures, planning, proposal, program, project, standard and technical
specification, and economic-technical norms in the field of resources and
environment as effected by the higher-level authority; disseminate, communicate
and educate laws on resources and environment in the province.
* With reference to land property
1. Preside over and combine with relevant units in
order to set up and rectify the planning and proposal of local land usage
submitted to provincial People’s Committee; instruct, investigate the compliance
with the approved planning and proposal of land usage
2. Arrange to assess the planning and proposal of
land usage that shall be submitted to provincial People’s Committee by district
People’s Committee; monitor the compliance with the planning and proposal of
approved land usage at the district level.
3. Arrange to assess the documentation and
recordation of land allocation, lease, reclamation, transfer of use right, use
purpose change, and the certification of land use right, ownership and linked
properties;
4. Grant the certificates of land use right and
ownership, linked properties as assigned by provincial People’s Committee; sign
the contract of land lease, license the registration of land use right,
ownership and linked properties as regulated in laws.
5. Instruct and inspect the compliance with the
procedure regarding land allocation, lease, reclamation, right transfer and
ownership, usage of linked properties and the registration of land use right;
proceed with and monitor the cadastral records, the use right and obligations of
land users.
6. Instruct, investigate and carry out the
inspection, survey, measurement, assessment, rating of land; set up and correct
changes on cadastral map, contemporary condition of land use, and planning map
of land use; produce statistics and inventory of land and set up the land
information system at provincial level.
7. Preside at defining land price and submitting
Department of Finance to make their assessment prior to submitting to provincial
People’s Committee for regulating annual periodic definition in the local areas,
which must be in line with the structure of land price issued by government;
propose the solutions to handling difficulties with land price; inspect, collect
and provide information and data concerning land price;
8. Preside over, combine with relevant units to
instruct, investigate and work on the indemnification and assistance of
relocated residents whose land was reclaimed as regulated in laws;
9. Work out and inspect the fee collection of land
allocation, lease and use purpose change, and the tendering of land-related
projects;
10. Organize and supervise all of the activities at
Office of land use right registration at provincial level, and instruct, inspect
all of the activities at Office of land use right registration at district
level.
* With reference to water resources
1. Preside over and combine with relevant units to
set up the planning and proposal of water resources administration, usage and
preservation; preserve and protect the declining and worn-out water source; and
abide by those that have been approved.
2. Proceed with the
assessment on projects concerning the exploration and utilization of water
resources and water transfer among the river valleys as approved by provincial
People’s Committee;
3. Work on defining the limitation of exploring
water from rivers, water containing layers and reservoirs, restricted water
exploration, and the proposal of equal distribution of water in local areas;
4. Make assessment on the records of extension,
deadline change, content rectification and validity suspension and reclamation
of license of detecting, exploring and using water resources, draining waste
water into water resources and drilling underground water as authorized; grant
license and collect fee concerning water resources as mentioned in the license.
5. Arrange to conduct the basic inspection,
inventory, statistics and storage of water resources data throughout local
areas; monitor and explore the surveying projects of water resources invested
and built locally.
6. Totalize the state of exploring and using water,
and give an overview of waste sources into water at local areas; list polluted,
declined and exhausted water sources at local areas;
7. Instruct and inspect the covering of abandoned
wells as regulated in laws;
8. Participate in the intersectional alliance of
central and standing committees with local ones in order to monitor, explore and
protect water source from river valleys.
* With reference to mineral resources
1. Preside over and combine with relevant units to
locate the prohibited areas for mineral operations, define the tendering areas
for mineral detection and exploration as authorized by provincial People’s
Committee; propose preservative approaches to mineral resources and submit to
provincial People’s Committee.
2. Make assessment on the projects of detecting
mineral for common building material production and peat; Take part in building
up the planning of detecting, exploring, processing and utilizing kinds of
mineral as licensed by provincial People’s Committee;
3. Arrange to assess documents regarding the
granting, extension, reclamation and return of mineral license; give permission
to transfer and continue the right of mineral operation in respect of being
inherited and other projects regarding the closure of mines as decided under
authority of provincial People’s Committee;
4. Arrange to assess the reports on detecting
mineral as common building materials and peat as approved by the authority of
provincial People’s Committee;
5. Investigate, inspect and supervise mineral
operations from organizations and individuals; arbitrate on disputes, complaints
and accusations over mineral operations, and handle or suggest the settlement
over law breaking cases regarding mineral operations as regulated in laws;
6. Manage, store and provide information and data
about mineral detection as building materials and peat; make statistics and
inventory of mineral storage that has been approved of and periodically reported
to Ministry of Resources and Environment.
* With reference to environment
1. Arrange to evaluate the environment status at
local areas in the periodical way; investigate and determine the polluted areas,
prepare the list of those units that pollutes environment in the province and
periodically report to provincial People’s Committee, Ministry of Resources and
Environment as stipulated in laws; control the remedies of environmental
pollution at these units;
2. Preside over or combine with relevant units to
set up and carry out the proposal of promoting existing sources in order to cope
with and solve environmental pollution caused by natural effects as assigned by
provincial People’s Committee;
3. Grant, extend and reclaim license from those who
happen to waste, collect, transport and process solid dangerous wastes as
regulated in laws; instruct, inspect and certify the qualification of waste
import as properly authorized;
4. Arrange to assess the reports on evaluating
environment and environmental effects, the projects of environmental
preservation for those projects that are developed outside industrial zones, or
the projects of founding natural and biological diversified reserves as approved
by the authority of provincial People’s Committee; instruct and inspect the
compliance after approval;
5. Preside over and combine with other units to work
out the program and project of protecting, restoring and reforming environment
and surroundings, preserve and develop underwater lands in the sustainable way
as assigned by provincial People’s Committee;
6. Give guidance to establish, organize and monitor
the environmental survey system as regulated in laws; make statistics and record
environmental data at local areas;
7. Hold communication activities in protecting
environment in the authoritative scope of the Department;
8. Arrange the fee collection for the assessment and
report of environmental effects and protection concerning the waste substances
as regulated in laws;
9. Totalize the estimate of non-business payment for
environmental protection at offices and units throughout areas in the province;
combine with Department of Finance to report to provincial People’s Committee to
submit to People’s Council at the same level; Preside over and combine with
Department of Finance to administrate the environmental protection fund of the
province.
* With reference to hydrometeorology
1. Arrange to assess the documents for granting,
extending and justifying content, reclaim the operational license of dedicated
hydro meteorological works at local areas as authorized by People’s Committee,
and supervise the operations.
2. Preside at assessing the projects of investment,
construction, improvement and upgradation for dedicated hydrometeorological
works; take part in setting up plans for protecting, preventing and restoring
disasters’ consequences at local areas
3. Assume responsibility for combining with relevant
units and offices at Central committee and localities in protecting, dealing
with violations against technical safety at the Central’s hydrometeorological
works in the province;
4. Review and report the condition and effect of
environmental changes on natural factors, human beings and socio-economic state
at localities; combine with relevant departments to propose and recommend the
appropriate solutions.
* With reference to measurement and mapping
1. Verify the registration; assess documents and
propose authoritative units to grant, supplement, extend and reclaim the
operational license of measurement and mapping as regulated in laws;
2. Organize and monitor the measuring and mapping
activities as planned; supervise the quality of the measuring and mapping works;
manage all of the measurement and mapping data in the similar way at localities;
ensure the confidentiality, storage and provision of measuring and mapping data
and figures’
3. Control, build, upgrade and develop the technical
infrastructure system of measurement and mapping, including basic measurement
places, data system of information base, places in the map, cadastral map and
administrative map, foundation map, other maps intended for specific purposes,
and topographic map;
4. Keep track of publishing and issuing maps and
request authoritative units to suspend the publishing, reclaim the map
incorrectly showing the country’s sovereignty, administrative borders and local
places, or prints of technical error map.
* Other assignments
1. Instruct the professional state administration
concerning resources and environment over Resources and Environment Subdivision
at district level, and those specialists who involve in the state administration
regarding resources and environment for People’s Committee at commune, ward and
township levels (hereinafter generally called communal People’s Committee)
2. Seek the international cooperation within the
management of the Department as regulated by laws, assigned or authorized by
provincial People’s Committee; preside at or take part in assessing, evaluating
and developing researches and projects applying technological advances of
resources and environment throughout local areas.
3. Conduct the guidance and inspection over the
mechanism of self-control and self-help at non-business units of the Department
and other local state-owned ones in the field of resources and environment as
regulated by laws; bear responsibility for state-run services performed by the
Department.
4. Help provincial People’s Committee to carry out
the state administration over businesses, economic organizations and
individuals; instruct and inspect the activity of non-governmental associations
and organizations in resources and environment field as regulated by laws.
5. Investigate, inspect and treat any violations in
those fields that are put under the management and control of the Department as
stipulated in laws; arbitrate in complaints, accusations; prevent and battle
against corruptions as regulated and assigned, depending on administrative
levels, by provincial People’s Committee
6. Regulate function, duty, authority and
organization mechanism and working relation at the office, inspectoriat and
other specific subdivisions or non-business units of the Department;
administrate personnel, follow up salary regime and policy, benefit and welfare,
training, education, compliment and reward, punishment for public staffs or
officers at district and commune levels, who are working on the state
administration over resources and environment.
7. Monitor finance and property at the Department as
regulated in laws and assigned by provincial People’s Committee.
8. Form the data base of resources and environment;
make the statistics and reports on management states and preservation of
resources and environment at local areas as regulated in laws.
9. Assist provincial People’s Committee in assessing
the records, outlines and estimates of budgeting and financing the resources and
environment tasks at local areas, depending on suitable administrative level;
modify and reclaim permits and certificates managed by Department of Resources
and Environment as regulated in laws, assigned or authorized by provincial
People’s Committee.
10. Combine with Department of Finance, Planning and
Investment to submit to provincial People’s Committee to determine the target
and plan for professional tasks, and estimate the payment and cost of sectorial
budget. Administrate and make most use of state budget as abided by regulations
and laws, which guarantees effectiveness. Arrange to collect various fees
concerning resources and environment as regulated in laws.

Technical Center for Land
and Real Estate
The Centre has legal status and its own seal. It
ensures its whole operation expenses in accordance with Decree No. 10/2002/ND-CP
dated January 16 2002 of the Government.
The Centre provides technical services on land and
real estate (as filling orders placed by the State, as assigned by the
authority, and carrying out contracts with other organizations and individuals),
including:
Measuring maps; draw up land use planning; perform
services related to planning for urban construction and rural population centres
and technical work related to land and real estate
Providing consultancy on law and other services in
the field of land (real estate services, real estate valuation, real estate
trading floor ,...);
Doing
research, applying and designing softwares and transferring technology in the
field of land and real estate technically
Office for Land-Use Right
Registration
Land Use Right Registration Office is a public
service unit, operating as a unit that ensures part of its regular operation
expenses on its own under Decree No. 10/2002/ND-CP dated January 16, 2002 by the
Government,
The Office has legal personality, official seal, and
it can open account at the State Treasury and banks as stipulated. It
has the functions as followed:
Organize the registration of land use and adjust
land use fluctuations; manage cadastral dossiers, implement administrative
procedures in terms of land use and land management in accordance with
provisions of law;
Perform work related to information about land,
natural resources and environment
Center for Environmental
Observations and Engineering
The Centre has legal status and its own seal. It
ensures its whole operation expenses in accordance with Decree No. 10/2002/ND-CP
dated January 16 2002 of the Government. It can open account at Dong Nai State
Treasury. The Centre has the following functions:
• Perform environmental
techniques in the fields assigned by the Department
• Provide environmental services;
• Do research on application of S&T advances in the field of environment
monitoring and analysis.
Environmental Protection
Fund
Environmental Protection Fund
is a state financial organization, providing financial support in the field of
environmental protection. It ensures its whole operation expenses, has legal
status, has its own official seal and it can open account at State Treasury and
