Supervision at Ngo Han Joint Stock Company, Long Thanh District shows that this enterprise still has many limitations
in compliance with Law on Labor. Specifically, the annual OSH implementation
plan has not been developed, periodical health check-ups and occupational
diseases have not been established for employees, and the operating procedures
for occupational safety have not been developed. For the implementation of the Law
on Labor, the company has not well implemented the democratic regulations and
policies towards female employees. Along with that, the enterprise still owes
union fees and has not created favorable conditions for grassroots Trade Unions
to operate.
In addition to Ngo Han Joint Stock Company, some
businesses also have similar limitations such as: organizing employees to work
overtime beyond the prescribed time; incomplete classification of the number of
workers doing heavy, hazardous and dangerous jobs, workers doing jobs with
strict requirements on OSH, etc. Explaining the above situation, enterprises
said that due to the epidemic in the past 2 years the production conditions
have become more challenging, so the implementation of a number of legal
regulations has not been implemented timely.

Thanh Hong, Vice Chairman
of the Provincial Confederation of Labor said that through supervision, the delegation had
physically checked the records and papers related to the policies of employees
at the enterprise; at the same time, directly go down to the workshop to survey
the working environment, OSH work and know about the situation of employment,
income and workers' life. Regarding the inadequacies in the implementation of
regulations on Labor Law, the delegation suggested enterprises eliminate the
above limitations. At the same time, it is required that enterprises strictly
abide by labor law provisions such as: implementing well the democratic
regulations, holding dialogues at the workplace, building a salary scale and
paying a salary commensurate with the requirements of workers' jobs.
Solutions
are necessary
According to Mr. Ho Thanh Hong, over the past time,
the Provincial Confederation of Labor has coordinated with departments and
branches in the province to synchronously implement many solutions to raise the
awareness of abiding by the provisions of the Labor Law, creating the harmonious,
stable and progressive labor relationships at enterprises. Along with that,
promoting propaganda and dissemination of Law on Labor to employees is a very
important task of the Trade Union. However, violations of labor laws still
occur in many places.
In addition, the Department of Labor, War Invalids and
Social Affairs regularly organizes inspection groups to inspect the
implementation of Law on Labor at enterprises and take many forms of timely
sanctions. However, in many enterprises, the implementation of Law on Labor is
still formal and has not really achieved high efficiency. Specifically, when an
enterprise signs a contract with an employee, the content of the labor contract
is not fully written or not specific; signing labor contracts in contravention
of regulations, jobs of a regular nature but signing labor contracts with a
term or a seasonal basis.
Besides the mistakes of enterprises, on the part of
employees, their awareness of Law on Labor is still limited, so they are not
conscious of protecting their legitimate rights and interests. In addition, the
propaganda and dissemination of Labor Law has only been at the management
department of the enterprise and has not yet reached the employees, which is
also a reason why employees still lose their rights when working at
enterprises. In which, enterprises owe social insurance, salary debt, illegal
dismissal or workplace arrangement that is not as committed in the labor
contracts.
Mr. Cao Duy Thai, Deputy Head of the Department of
Labor Policy under the Department of Labor, Invalids and Social Affairs, said
that in the coming time, the Department will organize many training sessions on
Labor Law for business owners, personnel working in human resources, and Trade
Unions to master the regulations and perform well at enterprises. The training
contents focused on labor policies, wages, labor relations. In addition, the
training conference also raised some common situations, exchanged and answered
problems in the implementation of labor policies at enterprises on labor
contracts, wages, labor discipline and material responsibility, labor disputes.
Mr. Le Duc Thuy, Vice
Chairman of the Trang Bom Confederation of Labor said that one of the urgent
measures to limit enterprises' violations of the Labor Law is to strengthen
coordination among the provincial branches in inspection. To consult and guide
enterprises to well comply with the provisions of labor law. Enterprises are
required to strictly implement policies for employees, and at the same time
implement measures to ensure occupational safety and health, in order to
minimize occupational accidents and diseases in production and business.
