 I. Position, functions, and headquarter of the provincial People’s Council Office:

*Position, functions of the Provincial People's Council Office:

- The provincial People’s Council Office is an assistant machine of People’s Council, Standing People’s Council and committees of the provincial People’s Council. It is in charge of organizing and assisting activities of People’s Council, Standing People’s Council, and committees of People’s Council, People’s Council representatives teams, representatives of the provincial People’s Council and giving advice for some tasks assigned by the provincial Standing People’s Council.  

-The provincial People’s Council Office has its own seal. The expense for its operation is among that of the the provincial People’s Council and  based on the decision of the Provincial People's Council  on apportionment of yearly budget estimation in accordance with law regulations. The provincial People’s Council Office can open its account at the provincial state treasury for its transactions according to current regulations.   

*The headquarter of the provincial People’s Council Office.

The headquarter of The provincial People’s Council Office is the regular work place of the Standing, committees of the provincial People’s Council and the provincial People’s Council Office. For the time being, the headquarter of The provincial People’s Council Office locates in the head office of the state administrative bloc of the province on Number 2, Nguyen Van Tri street, Thanh Binh ward, Bien Hoa city, Dongnai province.   

II. Missions and authorities of The provincial People’s Council Office: 

-To help the provincial standing People’s Council, committees of the provincial People’s Council build programs, plans for activities, monthly, quarterly, every-six-month supervising programs of the provincial People’s Council, the standing, committees of the provincial People’s Council and give support to implement those programs.

-To support the provincial People’s Council, representatives of the provincial People’s Council in conducting plans for activities and monthly, quarterly and every-six-month programs approved by the provincial People’s Council, the provincial Standing People’s Council.

-To organize service for delegations of the provincial People’s Council in interacting with citizens, help the provincial standing People’s Council in organizing receipt and transmitting petitions of citizens, supervise and speed up dealing with citizens’ complaints, denunciation as well as petitions which representatives of the provincial People’s Council transfer to competent agencies and organizations to settle.

-To organize and support representatives of the provincial People’s Council in interacting with electors, help the provincial standing People’s Council in collecting opinions, petitions of electors, ask and answer questions according to regulations, and then send them to competent offices, organizations to examine, answer questions, and solve those petitions in accordance with law regulations.

-To help the provincial standing People’s Council to organize, prepare, serve sessions and ensure activities of representatives of the provincial People’s Council at sessions according to regulations of the provincial People’s Council and other law regulations. 

-To help the provincial standing People’s Council regulate and harmonize the provincial People’s Council committees’ activities of examination reports and projects assigned by the provincial standing  People’s Council. 

-To collaborate with the provincial People’s Council committees and the provincial People’s Council Office to prepare reports on activities of the provincial People’s Council; check the form and content of reports before submitted the provincial People’s Council and the provincial standing  People’s Council for examination and approval; cooperate with functional agencies to communicate resolutions of the provincial People’s Council on mass media. 

-To make estimation about monthly, quarterly, and yearly expenditure of the provincial People’s Council and be in charge of management, expense, financial balance sheet of the provincial People’s Council according to state financial system; support and ensure enough conditions, means, and facilities for activities of the provincial People’s Council, the provincial standing People’s Council Office, delegation teams of the provincial People’s Council, and representatives of the provincial People’s Council.

-To manage letters and storing documents and files of the Provincial People's Council, Standing Committee of Provincial People's Council, committees of the Provincial People's Council in accordance with law regulations.

-To manage organization and personnel as well as assets, equipments, facilities of the Provincial People's Council  in accordance with law regulations.  

-Carry out other tasks assigned by the Provincial People's Council and Provincial Standing People's Council .

III. Structure of Organization and Personnel of the Provincial People's Council  Office:

Leaders of the Provincial People's Council Office has the office chief with  one or two deputy chiefs.

The chief and deputy chief of the Provincial People's Council  are appointed and dismissed by the Provincial Standing People's Council after consenting with Chairman of the provincial People’s Committee. 

Organization structure of the Provincial People's Council Office includes

-General Coordination Department.

-Administration-Management Department.

Personnel of the Provincial People's Council  Office:

Total personnel of the Provincial People's Council Office is 14 (not including the Provincial Standing People's Council, heads and deputy heads of committees of the Provincial People's Council).     

IV. Functions, Authorities of heads of the Office and Subordinate Divisions of the Provincial People's Council  Office:

*Working mode of department heads:

Department heads work under regime of chief officers.

Following tasks are conducted according to regime in which leaders manage and make decisions following majority.

-Policies, missions, assignment program and reports of yearly and six-year mission implementation of the office.

-Issuance of rules and working statues of office leaders, specialized departments of the office.

-Tasks of planning cadres, appointing, placing, assigning, accepting, recruiting, dismissing, superannuating, raising salary, awarding, disciplining cadres, civil service employees; tasks of appointing cadres to study and to be trained home and overseas; matters relating to civil service employees.

-Tasks of constructing basically, buying assets and equipments in accordance with current regulations of the government.

*Missions and authorities of the Chief of the Provincial People's Council  Office.

The Chief of the Provincial People's Council Office is the one managing generally activities of the the Provincial People's Council  Office, taking the blame for the whole activities of  the Provincial People's Council Office from the provincial Standing People’s Council, but not dealing with assignments devolved upon others, taking others’ assignments, or acting as a one-man show.

The Chief of the Provincial People's Council Office directly gives guides following work:

-Acting as a counselor for the Provincial People's Council (as a member of the provincial Standing People’s Council) and dealing with daily work. 

-Checking, completing drafts and documents of the Provincial People's Council , the Provincial Standing People's Council before they are inspected and issued; informing work reports, projects, statements of the Provincial People's Council Office for submitting the Provincial Standing People's Council.  

-As entrusted by the Provincial Standing People's Council, the chief of the Provincial People's Council Office is the account owner for expense of the Provincial People's Council operation ( including expense of Provincial People's Council operation), the investor of basic construction project with expense of the Provincial People's Council  and the Provincial People's Council Office, manages, using expense and assets that the Provincial People's Council  has a right to use in accordance with Decision of the Provincial People's Council , the Provincial Standing People's Council and current law regulations.        

-To be responsible for organizing accounting and statistics machinery to conduct tasks of managing, spending, drawing the balance sheet and forming financial reports of the Provincial People's Council in accordance with financial regime that the government issued; to invest in basic construction, purchase and preserve assets of the Provincial People's Council  and the Provincial People's Council Office.

-Directly lead tasks of organization, administration, management of the Provincial People's Council Office.

-Play the role of the Council chairperson of emulation, awards, and disciplines of  the Provincial People's Council Office.

-Play the role of party committee secretary of the Provincial People's Council according to assignments of the party committee.

- The Chief of the Provincial People's Council Office attends conferences and supervising and studying visits of the Provincial People's Council, signs official correspondence, announcements, letters of meting invitation, as well as other documents by order of the Provincial Standing People's Council. 

*Missions and authorities of the Deputy Chief of the Provincial People's Council responsible for general tasks.

The Deputy Chief of the Provincial People's Council who is holding concurrently the position of Department Head of General Coordination is the one that helps the chief with information collection; able to use the authority of the chief to settle work and take the blame with the chief for their own decisions; not deal with assignments devolved upon others; not take others’ assignments, or not act as a one-man show.

Specific missions and authorities as follows:

-General tasks

-Cooperating with committees of the Provincial People's Council, functional departments of the Provincial People's Council Office, provincial Party Committee Office, National Assembly Delegation Office, the Provincial People's Committee Office to help the chief of the Provincial People's Council office with drawing up weekly work schedule of the standing and committees of the Provincial People's Council.

-Draft operation and supervision programs o f the Provincial People's Council, the Provincial Standing People's Council, committees of the Provincial People's Council and hold supervision for implementation of those programs.  
-Editing, correcting, drafting the Provincial Standing People's Council’s reports that project investors or the office authorities prepare.  

-Settling and taking responsibility for matters in general areas, tasks of emulation and award of the Provincial People's Council and information technology of the Office.

-Deputy Chief of the Provincial People's Council Office attends and appoints secretary of meetings, supervision, surveys of the Provincial Standing People's Council and committees of the Provincial People's Council; the Deputy Chief deputizing for the chief to sign documents, announcements, appointment invitations in assigned areas along with other documents when assigned and authorized by the Chief.        

-Joining in the Editorial Board and taking responsibility for contents of news-letters of the Provincial People's Council (monthly edition); compiling, editing, printing, publishing yearbooks of the Provincial People's Council’s meetings together with other publications following guidance of the Provincial Standing People's Council; being responsible for exploring and supplying information to the Provincial People's Council’s representatives; providing information and speaking in front of press and other organization and individuals according to guidance of the Provincial Standing People's Council. 

-Carrying out some other responsibilities, missions when assigned and authorized by the Chief. 

*Responsibilities of the General Coordination Office:

The General Coordination Office works under leadership regime, direct guidance and management of the Deputy Chief  concurrently acting as the Office Head is responsible for general tasks and takes blame from the Chief for all activities of the office. Missions as follows:

-Specific assignment of each professional appointed by the Deputy Chief responsible for general tasks. When necessary, the standing, head or deputy head of committee or chief of the Provincial People's Council Office (leaders for short) can directly work with professionals, but then professional is responsible for reporting the work content along with guidance of leaders to the Deputy Chief undertaking office work generally, except leaders’     request of not reporting or popularizing the third people. 

-Drafting and overseeing implementation process of working program and statuses of the Standing and committees of the Provincial People's Council.

-Serving the Standing and committees of the Provincial People's Council in doing tasks of assessing resolutions, statements, projects submitted by offices responsible for submitting the the Provincial People's Council; acting as the secretary writing up minutes of meetings and drawing up concluding announcement of conferences, supervision, surveys of the Standing, committees and the Provincial People's Council Office; watching over and hurrying organizations and individuals in carrying out conclusions and proposals of the supervising and studying delegation of the Provincial People's Council to report to the Standing and committees of the Provincial People's Council for consideration and decision; watching over and wrapping up tasks of emulation, award, and discipline of the Provincial People's Council.

-Drafting and joining to draft documents of the Provincial People's Council, the Standing, committees, and the Provincial People's Council Office.

-Supervising, summing up situations of socio-economy and security and national defense and law enforcement in the province; timely detect problems and propose solutions for serious problems to the Standing, committees and the Office. 

-Studying legal documents and ones in areas of economy, finance, culture, society, religion, nationality, social defense, law enforcement to act as a counselor of the Standing and committees of the Provincial People's Council.   

-Overseeing, summing up and transferring to offices having authority to deal with citizens’ complaining and denouncing forms and letters sent to the Provincial Standing People's Council, committees of the Provincial People's Council and representatives of the Provincial People's Council; supervising and urging citizens’ sent complaining and denouncing form and letter settlement.  

-Summing up opinions of constituents, questions of representatives and then transfer them to offices ang people having authority to answer and settle to report to the Provincial Standing People's Council. 

-General Professional can attend meetings of the Provincial People's Council, of the Standing, committees and the Office of the Provincial People's Council and other meetings of the province when assigned.

-Editing, correcting documents of the Provincial People's Council, the Standing, and its committees before they are submitted to sign for issuance.   

-Preserving files and documents and ensured sufficiently preserved files and legally; keeping secret about assignments in accordance with law regulations.

-Carrying out some other assignments when given by the Standing, leaders of committees and the Provincial People's Council Office.

*Missions of the Administrative and Management Office:

The Administrative and Management Office works under leadership regime, management of the head of Administrative and Management Office. The head helps the chief with tasks of managing and organizing cadres and matters in fields of administration and management and takes the blame for every activity of the office with the chief. Specific missions as follows:

-Taking responsibility for organizing archives and records management and taking the blame for document form when they are released; receiving, registering, managing incoming and outgoing documents and supervising closely process of document rotation; reporting timely to the chief for treatment when necessary; receiving incoming files, registering and delivering them to the right addresses according to opinions of the standing, committees of the Provincial People's Council and leaders of the Office; dealing with files handed to preserve, release files and newspapers timely; implement strictly security regime in accordance with law regulations.

-Typing, duplicating, printing, doing photocopies of documents to serve the Provincial People's Council, the Standing, committees, representative groups and representatives of the Provincial People's Council at the office leader’ request.

-Managing, stamping, issuing travel warrants, introduction papers, and other documents in accordance with law regulations.   

-Collecting, controlling work of file management of the Provincial People's Council (including files of the Standing, committees, representative groups, and representatives of the Provincial People's Council), of departments, committees, unions of the province, files of Central government, party organizations, government that are sent to the Provincial People's Council Office.  

- -Helps the chief with making reports to the Provincial Standing People's Council and Governmental Office for work of archives and records management, cadre organization of the Provincial People's Council Office in accordance with regulations of the government and requests of the Office head.  

-Organizing exact and timely implementing regulations and policies; guaranteeing operation expense of the Provincial People's Council and the Provincial People's Council Office as demanded by the Standing, committees, and head of the Provincial People's Council Office according to approved plans and estimation; executing justly regulations of finance, payment,  balance sheet drawn; reporting to the chief of the Provincial People's Council and higher-rank financial agencies in accordance with law regulations.      

-Satisfying demands of vehicles to serve operation of the Standing, committees, representatives, and the Office according to appointment of the chief.   

-Implementing tasks of having festivals, protocol, diplomacy to serve the standing, committees, representatives, and the Provincial People's Council Office in case guests in, out of the province and overseas visit and work with the Provincial People's Council.

-Managing infrastructure, technique, property that were equipped; making plans of shopping, fixing, replacing, maintaining, distributing, inventorying, liquidating various assets, goods as demanded by the Provincial Standing People's Council and head of the Office.

-Receiving, distributing goods and cash to serve activities of the Provincial People's Council and the Provincial People's Council Office when having enough legal documents; having a right to refuse to receive, distribute goods and cash when not having sufficient legal documents.   

-Serve work of paying salary and other expenses to Vice-Chairperson, member of the the Provincial Standing People's Council, head and deputy head of committees, public servants of the Provincial People's Council Office along with subsistence expenses of representatives of the Provincial People's Council and other expenses that competent offices of the government and province stipulated.      

-Associating with trade union and other union organizations to care about material and spiritual life of public servants that the office has to pay.   

-Overseeing, checking, urging public servants to implement exactly rules that the headquarter issued; assigning public servants to join militia units, fire control teams of the headquarter as demanded by the headquarter management board; ensuring and preserving sanitation and order, safety and awareness of trick prevention and security along with fire control.  

-Acting as a consultant of head of the Office to deal with irrationality and shortcomings in the process of managing use of expenditure, property, other infrastructure of the office to ensure rational and economical use and waste and loss prevention.  

-Undertaking other tasks when assigned by the office head.

V. Working mode of the Provincial People's Council Office:

*Building working program of the Provincial People's Council and the Provincial Standing People's Council:

-Pursuant to People’s Council and People’s Committee Organization Law passed by National Assembly (term XI) and resolutions of the provincial Party, the Office helps the Provincial Standing People's Council with building the whole term program of the Provincial People's Council, specifying working program, supervising program of the Provincial People's Council in six months and the whole year to submit the meeting.  

-Pursuant to working and supervising program in six months and the whole year of the Provincial People's Council, the Office assists the Provincial Standing People's Council in building monthly and quarterly working and supervising program of the Standing, committees of the Provincial People's Council and watching over, reporting deployment and implementation results.

*Organizing informing work:

-The office receives and organizes task of information exploitation from reports, meetings of sectors, levels of the province and the nation; exploits information from mass media, internet; organizes edition of news of the Provincial People's Council to provide information to representatives of the Provincial People's Council.
